Terms of Service

1. Acceptance of terms

By accessing or using MegaClaw ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of service

MegaClaw is an IT automation platform that enables users to connect services, execute tasks via AI, manage integrations, and automate workflows through a REST API, Webhook, MCP Server, and web UI.

3. Account registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and API keys. MegaClaw is not liable for unauthorized access resulting from your failure to secure your credentials.

4. Acceptable use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Access systems or data you are not authorized to access
• Attempt to reverse-engineer, decompile, or copy the platform
• Transmit malware, spam, or harmful content through integrations
• Resell access to the Service without written authorization

5. Data and privacy

Your use of data within MegaClaw is governed by our Privacy Policy. Integration credentials are encrypted with AES-256 and fully isolated per tenant. We do not share your data with third parties or use it to train AI models.

6. Tokens and billing

MegaClaw uses a token-based model. Token consumption depends on task complexity and the AI provider used. If you bring your own API key (BYOK), no tokens are deducted. Unused tokens do not carry over between billing periods. Refunds are handled on a case-by-case basis.

7. Service availability

We aim for maximum availability but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance. SLA guarantees apply to Enterprise plans only.

8. Intellectual property

MegaClaw and all associated trademarks, logos, and service names are the property of MegaClaw. You retain ownership of your data and integration configurations.

9. Limitation of liability

To the maximum extent permitted by law, MegaClaw is not liable for indirect, incidental, or consequential damages arising from your use of the Service. Our liability is limited to the amount paid by you in the three months preceding the claim.

10. Termination

We may suspend or terminate your account for violations of these terms. You may cancel your subscription at any time. Upon termination, your data is retained for 30 days before deletion.

11. Governing law

These terms are governed by the laws of Germany. Disputes shall be resolved in the courts of Germany.

12. Changes to these terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised terms.
